Welcome to Insurance.ai, an AI-powered application designed to assist users in understanding their options regarding ACA and Medicare health plans. This Terms of Service (TOS) agreement governs your use of the Insurance.ai app, including features that allow users to connect their Medicare information through the CMS Blue Button 2.0 API. By using the app, you agree to comply with and be bound by these terms and conditions.

Insurance.ai adheres to all CMS.gov guidelines and is compliant with the Health Insurance Portability and Accountability Act (HIPAA). We take user privacy and data security very seriously and have implemented measures to ensure that all personal and health information is protected at the highest level. Our app integrates with the CMS Blue Button 2.0 API, allowing users to connect and import their personal Medicare data. By connecting your Medicare account, you authorize Insurance.ai to access your Medicare claims data to provide more personalized recommendations and assistance.
User Authorization
Users must authorize the app to access their Medicare data using OAuth 2.0, a secure authentication process. You are responsible for the accuracy of the information provided during the authorization process. You must keep your CMS credentials secure and confidential.
Data Use and Limitations
Insurance.ai will only use the imported Medicare data to provide personalized assistance and recommendations regarding Medicare and ACA plans. We do not share your Medicare data with third parties unless explicitly required by law or as part of our data-processing policies, as outlined in our Privacy Policy. We may store your data to improve the user experience, but we will never sell or misuse this data.
The app is intended for individuals who are at least 18 years old, and enrolled in or seeking information about Medicare or ACA health plans. You are solely responsible for ensuring that your use of the app complies with all applicable laws, including but not limited to CMS and HIPAA regulations.
Insurance.ai incorporates an AI chatbot that provides users with guidance and information on ACA and Medicare plans. The AI chatbot provides real-time information based on the user's questions and imported Medicare data (if connected). The chatbot is programmed to assist with general inquiries and is not a substitute for professional healthcare advice. Recommendations provided by the chatbot are for informational purposes only and should not be construed as legal, financial, or medical advice.
Insurance.ai is not liable for any decisions you make based on the information provided by the AI chatbot. We encourage you to consult with a qualified professional for any healthcare or insurance-related decisions.
You will not use the app for any unlawful or harmful activities. You will provide accurate and up-to-date information during your use of the app. You are responsible for maintaining the confidentiality of your Medicare or ACA login credentials.
We are committed to ensuring the security of your personal and healthcare-related information. We employ encryption, secure data storage, and other advanced security measures to protect against unauthorized access, alteration, disclosure, or destruction of your data.
HIPAA Compliance: We comply with all relevant HIPAA regulations to protect your personal health information (PHI).
Data Breach Protocol: In the event of a data breach, we will notify you and the relevant authorities in compliance with HIPAA Breach Notification Rules.
You may revoke the app’s access to your Medicare data at any time by disconnecting the app via CMS Blue Button. We also reserve the right to terminate or suspend your access to the app if you breach these Terms of Service, misuse or abuse the app’s services, or face legal compliance issues. Upon termination, we will cease using and storing any data collected from your Medicare profile unless legally required to retain it.
All content, features, and functionality on the Insurance.ai app, including the AI-powered chatbot, code, and design, are the intellectual property of Insurance.ai. You may not reproduce, distribute, or modify any part of this app without prior written permission.
Insurance.ai is provided on an “as-is” basis. We do not warrant that the app will be error-free, uninterrupted, or free from any bugs, viruses, or harmful components. To the fullest extent permitted by law, Insurance.ai disclaims all warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Insurance.ai, its affiliates, or licensors be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising out of your use of the app or your reliance on any information provided by the AI assistant or from the Blue Button 2.0 integration.
We reserve the right to update or modify these Terms of Service at any time. If we make material changes to the terms, we will notify you by updating the date at the top of this page. Continued use of the app after any such changes constitutes your acceptance of the new terms.

These Terms of Service shall be governed and construed in accordance with the laws of the United States and the state of Minnesota, without regard to its conflict of law principles.
By using Insurance.ai, you consent to these Terms of Service, including the collection and use of your information as outlined herein.
